1. Acceptance of Terms

By accessing or using PigeonDB MarketPlace (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). The Platform is operated by AllBreed Solutions ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

PigeonDB MarketPlace is an online marketplace that connects buyers and sellers of racing and show pigeons. We provide a platform for users to list pigeons for sale, browse listings, make offers, and communicate with one another. We do not take possession of, buy, or sell pigeons ourselves, and we are not a party to any transaction between users.

3. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Platform. By creating an account, you represent that you meet these requirements.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when registering and to keep your profile information current. You may not transfer your account to another person.

5. Listings and Transactions

Sellers are solely responsible for the accuracy, completeness, and legality of their listings. By posting a listing you represent that:

• You own or have the right to sell the pigeon described.
• The listing is accurate and not misleading.
• The sale complies with all applicable laws, including any local regulations governing the sale of live birds.

Transactions are made directly between buyers and sellers. AllBreed Solutions does not process payments and is not responsible for the completion, quality, or outcome of any transaction.

6. Fees

We may charge a listing fee to activate a listing. All applicable fees will be disclosed before you are charged. Fees are non-refundable unless otherwise stated.

7. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings.
• Harass, threaten, or abuse other users.
• Use the Platform to facilitate any illegal activity.
• Attempt to circumvent our systems, scrape data, or access accounts without authorization.
• Post content that is obscene, defamatory, or infringes any third-party rights.
• Use the Platform to solicit transactions outside the Platform in order to avoid fees.

Violations may result in listing removal, account suspension, or permanent termination at our sole discretion.

8. Reviews

Users may leave reviews following a completed transaction. Reviews must be honest and based on your direct experience. We reserve the right to remove reviews that violate these Terms.

9. Intellectual Property

All Platform content, branding, and software are the property of AllBreed Solutions or its licensors. You retain ownership of photos and text you submit, but grant us a non-exclusive, royalty-free license to display that content on the Platform for the purpose of operating the service.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We make no representations about the quality, safety, legality, or accuracy of any listing.

11. Limitation of Liability

To the maximum extent permitted by law, AllBreed Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any transaction conducted through it. Our total liability to you for any claim shall not exceed the fees you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold AllBreed Solutions and its officers, directors, and employees harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your listings, or your violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Texas.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
